Terms of Service

These Terms of Service ("Terms") are an agreement between you and Everyone's Earth, Inc. ("Change Diapers," "we," "us," or "our"). They cover your use of changediapers.com (the "Site"), your account, and anything you buy from us, including subscriptions. By using the Site or placing an order, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site.

Subscription summary

If you start a subscription, here is what you are agreeing to:

  • It renews automatically. Your subscription continues, and we charge you and ship a new box on each renewal date, until you cancel.
  • How often: the frequency you choose when you subscribe.
  • How much: the subscription price shown when you subscribe and in your order confirmation, plus any applicable tax. Shipping is free within the contiguous United States. An introductory discount on your first box, if offered, applies to the first box only. Later boxes are charged at the regular subscription price.
  • When you are charged: on each renewal date, at the frequency you choose when you subscribe, to the payment method saved on your account. We email you a reminder before each renewal.
  • No minimum commitment. You can change, pause, or cancel at any time.
  • How to cancel: log in to your account and open Subscriptions, or contact us. To stop your next box, cancel by the day before your next renewal date.

1. Using the Site

You must be at least 18 years old, or the age of majority where you live, to create an account or buy from us. You agree to use the Site only for lawful, personal, non-commercial purposes. You may not interfere with the Site's operation or security, access it with bots or scrapers without our permission, or use it to send spam or harmful code.

2. Your account

An account may be created for you when you place an order. You are responsible for keeping your login details confidential and for activity in your account. Please keep your contact, shipping, and payment information current, and tell us right away if you believe someone has used your account without permission. We may suspend or close accounts that break these Terms.

3. Orders, pricing, and payment

  • Prices are in US dollars. Applicable sales tax is added at checkout.
  • Your order is an offer to buy. We accept it when we ship it. We may limit quantities, or refuse or cancel an order, including for suspected fraud, resale, or an error in price or product information. If we cancel an order you have already paid for, we will refund you in full.
  • We try to describe our products and prices accurately. If we find an error, we will correct it and give you the choice to continue at the correct price or cancel.
  • Payments are processed by our payment providers. By giving us a payment method, you confirm you are authorized to use it, and you authorize us to charge it for your orders, including recurring subscription charges.

4. Subscriptions and automatic renewal

How subscriptions work

When you start a subscription, you authorize us to charge your saved payment method for each renewal box at the frequency you selected, without further action from you, until you cancel. Your renewal date is the date each new box is charged and processed. The price, frequency, and first renewal date are shown before you place your order and in your order confirmation email.

Managing your subscription

Log in to your account and open Subscriptions to change your size, delivery address, delivery frequency, or next renewal date, to update your payment method, or to pause or cancel. Changes made by the day before your next renewal date apply to that box.

Cancelling

You can cancel online at any time in your account, or by contacting us. Cancelling stops future boxes. A box that has already been charged or shipped when you cancel is not affected, but it is still covered by our return policy. There is no cancellation fee.

Reminders and price changes

We will email you a reminder before each renewal is charged. If the price of your subscription goes up, we will tell you by email before the new price applies, so you have time to cancel if you do not want to continue.

Failed payments

If a renewal charge fails, we may retry your payment method and ask you to update it. If we cannot collect payment, we may pause or cancel your subscription.

Our changes

We may pause, change, or discontinue subscriptions or specific products. If we do, we will let you know, and we will refund any charge for a box we cannot send.

5. Promotions and discounts

Discounts, including any introductory discount on a first subscription box, are available only to eligible customers while the offer lasts. Unless an offer says otherwise, an introductory subscription discount is available only to households that have not had a Change Diapers subscription before and is limited to one per household. Offers cannot be combined with other offers, have no cash value, and cannot be transferred. We may end or change a promotion at any time, and we may cancel orders that use a promotion in a way it was not intended.

6. Shipping, returns, and exchanges

We currently ship only to addresses in the contiguous United States. Delivery dates are estimates. Title and risk of loss pass to you when your order is delivered to the carrier. Our returns and exchanges terms, including the 30-day window, are on our Shipping & Returns page and are part of these Terms. If an item is missing or a package is lost, contact us and we will make it right.

7. Product use and health information

Please use our products as directed on the packaging, choose the right size for your child, and change diapers regularly. Stop using a product and talk to your pediatrician if your child develops a rash or irritation that does not clear up.

Information on the Site, including content from or about doctors and other health professionals, is for general information only. It is not medical advice and does not create a doctor-patient relationship. Always ask your child's doctor about any medical concern.

8. Reviews and content you share

If you send us a review, photo, comment, or other content, you confirm that it is yours to share, that it is truthful, and that it does not violate anyone's rights. You give us a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, display, and share it, with your first name or username, on the Site, in marketing, and in other media. We may format it or shorten it for length, without changing its meaning. We may decline or remove content that is unrelated to our products, abusive, or otherwise breaks these Terms, whether it is positive or negative. Please do not share personal information about your child that you would not want to be public.

9. Our intellectual property

The Site and its content, including text, images, videos, logos, product names, and designs, belong to us or our licensors and are protected by law. "Change Diapers" and our logos are our trademarks. You may view and print pages for your personal use, but you may not copy, modify, distribute, or use them commercially without our written permission.

10. Text messages and email

If you sign up for marketing email, you agree to receive it at the email address you gave us. You do not have to agree to receive marketing messages to buy anything. You can unsubscribe at any time using the link in any marketing email. If we offer text messages in the future, we will show you their terms when you sign up. We will still send transactional messages about your orders and subscription. See our Privacy Policy for how we use your information.

11. Third party links and services

The Site may link to or rely on services we do not control, such as payment processors, carriers, and social media platforms. Their own terms apply, and we are not responsible for them.

12. Disclaimers

We work hard to keep the Site accurate and available, but it is provided "as is" and "as available." To the fullest extent the law allows, we disclaim all warranties not stated in these Terms, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, and we do not promise the Site will be uninterrupted or error free. Some states do not allow these disclaimers, so they may not apply to you. Nothing in these Terms limits any rights you have under consumer protection laws that cannot be waived.

13. Limitation of liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from the Site, our products, or these Terms. Our total liability for any claim is limited to the amount you paid us for the product or order the claim relates to. These limits do not apply to liability that cannot be limited by law, including for death or personal injury caused by our negligence, or for fraud.

14. Indemnity

You agree to cover our reasonable costs, including legal fees, if a third party brings a claim against us because you broke these Terms or misused the Site.

15. Governing law and disputes

These Terms are governed by the laws of the State of New York, without regard to its conflict of law rules. Any dispute will be resolved in the state or federal courts located in Westchester County, New York, and you and we consent to their jurisdiction, except that either of us may bring an individual claim in small claims court.

Before filing a claim, please contact us first. Most concerns can be resolved quickly that way.

16. Changes to these Terms

We may update these Terms from time to time. When we do, we will post the new version here and change the "Last updated" date. Changes apply from that date to new orders and continued use of the Site. If a change materially affects an active subscription, we will tell you before it takes effect, and you may cancel.

17. General

These Terms, together with our Privacy Policy and the policies they link to, are the whole agreement between you and us about the Site. If any part is found unenforceable, the rest still applies. If we do not enforce a right, we have not waived it. You may not transfer these Terms without our consent. We may transfer them as part of a merger, acquisition, or sale of assets. We are not responsible for delays caused by events outside our reasonable control.
